Property Regularization
Are you going to build, sell, or buy a property? Have you been notified or received a complaint?
Imagine finding the property of your dreams and discovering that the building is not registered on the deed. Or building the perfect house and suddenly receiving a notification from City Hall.
Although unknown to many, property regularization and registration (averbação) are fundamental. Failing to do so can stall the purchase and sale of the property and cause headaches with inspection authorities and neighbors. Understand how it works below!
What is property registration (averbação)?
To register (averbar) means to note or declare something in a public record. In practice, property registration is the history of all structural and legal changes made to the asset over time. Unlike the initial deed registration, it updates the actual situation of the property at the Real Estate Registry Office (Cartório de Registro de Imóveis).
Why is this document important?
Registration ensures legal security, transparency, and market appreciation. When buying or selling, it officializes the process and protects both parties against financial losses.
Main benefits:
-
Property information is always up to date;
-
Legal security and protection of rights;
-
Asset value appreciation;
-
Enables fast financing and quick sales.
When should you register changes?
It must be done whenever there are changes to the property or in the lives of the owners. Common examples:
-
Structural changes: New constructions, demolitions, expansions, or land subdivisions;
-
Changes in marital status: Marriages, divorces, probate, and estate distributions;
-
Cadastral updates: Changes to street names or property numbering;
-
Financial updates: Financing, payoffs, mortgages, or fiduciary assignments.

Generally, the step-by-step process involves:
-
Drafting the engineering projects;
-
Issuing the Building Permit (Alvará de Construção) and Certificate of Occupancy (Habite-se) with City Hall;
-
Filing the registration protocol at the Real Estate Registry Office.
Note: The entire regularization process takes around 6 months, a timeframe that must be considered during purchase and sale negotiations.
Clear your doubts about taxes:
-
Does a construction of up to 70m² pay federal social security tax (INSS)? According to Decree No. 3048/99 (Art. 278), no contribution is due to social security if the residential building is a single-family home, under 70m², intended for personal use, classified as affordable housing, and built without hired wage labor.
-
Does DIY/self-built construction pay ISS (Municipal Service Tax)? It depends on how the labor is utilized and reported. If the service tax was not prepaid, it will be charged later.
-
When does a construction tax expire? As a general rule, construction works completed over 5 years ago are no longer subject to the collection of social contributions (statute of limitations), provided proper proof is given.
How much do the ISS and INSS for your construction cost?
